These Terms and Conditions apply to consumer customers who purchase and use a SIM Local travel eSIM services for their own personal use ("you", "your" or "Customer").
They are intended to comply with applicable UK consumer protection laws and relevant Ofcom General Conditions applicable to prepaid travel connectivity services.
These Terms and Conditions constitute a legally binding agreement made between you and Sim Local (Ireland) Limited, a company incorporated in Ireland under number 489368 whose registered office is at 7th Floor Rsa House, Dundrum Town Centre, Sandyford Road, Dundrum Dublin 16, Dublin, Ireland ("SIM Local", "we", "us", "our"), concerning your purchase of a SIM Local eSIM ("eSIM"), for use on your personal device.
Where the Service is made available through a third-party distributor (including Tesco Stores Limited ("Tesco")), that distributor acts only as a sales channel and is not a party to your contract for the Service. Additional terms and conditions apply to your purchase of the Plans through Tesco (the "Tesco Terms"), which govern your interaction with Tesco as the sales platform and initial point of contact. These Terms and Conditions should be read alongside the Tesco Terms. In the event of any inconsistency, these Terms will apply to the provision of the Plans by SIM Local, and the Tesco Terms will apply to matters relating to the purchase process and Tesco's role.
By placing an order, you acknowledge that these Terms and Conditions apply to your purchase. You confirm that you have been provided with, or have had access to the key contract information (including details included in Clause 3 below), the contract summary and order confirmation on a durable medium (for example by email) following your order. Together, these documents form your agreement with us, and a legally binding contract will be formed when we issue the order confirmation.
SIM Local provides prepaid travel eSIM mobile data services. Our travel eSIM products:
SIM Local travel eSIMs do NOT support emergency calling services as the Service is data-only and does not provide voice calling (including emergency calls).
You cannot use the Service to contact emergency services numbers including:
You should keep access to an alternative mobile or fixed service capable of supporting emergency calling.
No out-of-bundle charges apply. Once your data allowance is exhausted or your Plan validity period expires:

SIM Local provides prepaid travel eSIM services either directly or through authorised partners, resellers, distributors, airports, retail stores, or online channels. Where you purchase the Service through a third-party distributor (including Tesco), SIM Local remains responsible for providing the Service and your contract will be with SIM Local.
SIM Local is not itself the operator of the underlying mobile telecommunications network infrastructure. The Service relies on third-party mobile network operators and roaming partners. Network availability, speed, quality, coverage, and technology (including 4G and 5G availability) may vary by:
Speed will be reduced on Unlimited plans once the daily data threshold is reached — data speed will be reduced to 1Mbps until the plan resets.

The Service ends automatically when your data allowance is exhausted, or the Validity Period expires — whichever occurs first. Unused allowances expire automatically at the end of the Validity Period and are not refundable, transferable or exchanged for cash or credit, except where required by applicable law.

At Sim Local, we aim to provide travellers with reliable, high-quality connectivity wherever they travel. Our Unlimited and Unlimited Plus eSIM plans are designed to offer generous daily high-speed data allowances for typical travel usage, including browsing, streaming, messaging, navigation and hotspot usage.
"Unlimited" refers to continued access to data services during the validity period of your plan. Daily high-speed data allowances apply as outlined within the relevant plan details.

Once the daily high-speed allowance has been reached, customers will continue to have unlimited data access at reduced speeds for the remainder of the day. Daily high-speed allowances reset automatically every 24 hours based on local network time in the destination country.
After using your daily high-speed allowance, speeds may be reduced to up to 1Mbps for the remainder of the day. Reduced speeds are suitable for essential online activities such as messaging, emails, maps and light browsing.
Reduced speeds may not support HD or 4K streaming, large downloads, video conferencing or other bandwidth-intensive applications.
This approach allows customers to remain connected whilst helping us maintain a fair and reliable network experience for all users.
Hotspot and tethering are included with all Unlimited and Unlimited Plus plans and can be used within your daily high-speed allowance.
Our plans are intended for personal travel usage and are not designed for permanent residential use, commercial usage or fixed broadband replacement.
Our Unlimited plans are intended for reasonable personal travel use.
To protect network performance and ensure fair access for all customers, Sim Local and its network partners reserve the right to apply traffic management measures in cases of:
Temporary traffic management measures may also be applied during periods of network congestion.
In exceptional cases involving abusive, prohibited or fraudulent usage, additional restrictions, speed limitations or suspension of service may apply.

Services are delivered through third-party network providers and Sim Local cannot guarantee uninterrupted service availability, network speeds or coverage in all locations.
Customers are responsible for ensuring:
Compatibility may vary by manufacturer, model and country of origin.
Sim Local reserves the right to update or amend this Fair Usage Policy from time to time in response to operational, regulatory or network requirements.
SIM Local does not guarantee:
This includes (but is not limited to) circumstances where:
5G access is available only where supported by the local operator, supported by your device, and included within the purchased Plan.
SIM Local may temporarily suspend access for maintenance, upgrades, security, legal compliance, or operational reasons. Where reasonably practicable, planned maintenance will be performed outside peak periods. Activation and connectivity may occasionally be delayed due to network availability or third-party provider systems.
If you experience any issues with the Service, please contact us and we will use reasonable efforts to investigate and help resolve them, including liaising with our underlying network partners where relevant. As the Service relies on third-party networks, availability and performance may be outside our direct control. However, where the Service is materially unavailable or degraded due to an issue within our control, you may be entitled to a partial refund or other appropriate remedy. To help us assess any such request, you should notify us promptly with reasonable details of the issue.
You agree:
SIM Local in its sole discretion and without liability to you, may suspend or terminate access where misuse is reasonably suspected.
If you have a query, request or complaint in relation to the Plans, you should contact Tesco customer support using the contact details set out in the Tesco Terms. Tesco acts as the initial point of contact on behalf of SIM Local and will pass your query or complaint to SIM Local where it relates to the Plans.
All complaints relating to the Plans will be handled and resolved by SIM Local as the service provider. SIM Local aims to resolve complaints promptly and fairly. Where possible:
A complaint is considered received when it is first submitted through one of our contact channels and we have sufficient information to investigate it, at which point we will confirm receipt and provide a reference number where applicable.
If a complaint cannot be resolved through normal support channels, Customers may request escalation to the SIM Local customer resolution team.
If you are not satisfied with how we have handled your complaint, you may be able to refer it to an independent Alternative Dispute Resolution (ADR) scheme. Where the UK Ofcom General Conditions of Entitlement apply to your service, we will: (a) provide you with details of our Ofcom approved ADR scheme; and (b) issue the required ADR notification once your complaint is eligible for ADR escalation under the applicable rules (including where the complaint remains unresolved after the relevant timeframe).
By purchasing an eSIM, you acknowledge that SIM Local processes personal data relating to you in order to make the Service available, to monitor and improve the Service, and to prevent unauthorised use, in accordance with applicable data protection laws, the UK GDPR, the EU GDPR where applicable, and our Privacy Policy.

Nothing in these Terms and Conditions excludes or limits liability which cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights under applicable consumer law.
The Service relies on third-party mobile network operators and other providers. While we will use reasonable care and skill in providing the Service, we do not control the underlying networks and are not responsible for issues arising solely from circumstances outside our reasonable control.
Subject to the above:
Nothing in these Terms and Conditions affects your right to seek a refund or other remedy where the Service does not conform with these Terms and Conditions or applicable law.
SIM Local may suspend or restrict access to the Service where reasonably necessary, including where required by applicable law or regulation, where fraud or misuse is suspected, or where this is necessary to protect network integrity or security (including where required by our underlying network providers).
SIM Local may also suspend or restrict the Service where this is reasonably required for maintenance, upgrades or operational reasons. Where reasonably practicable, we will provide advance notice of any such interruption.
As the Service is prepaid and time limited, it will terminate automatically when your data allowance is exhausted or the Validity Period expires.
You may stop using the Service at any time. No further charges will apply unless you choose to purchase a new plan.
If you experience a material and ongoing issue with the Service, you may contact us to request an appropriate remedy in accordance with these Terms and Conditions and applicable consumer law, which may include a partial refund where appropriate.
We may update these Terms and Conditions or the Service from time to time. If a change is material, we will provide notice in a clear and transparent way. Where required by applicable law or regulation, you will be given advance notice of material changes and, where those changes are not exclusively to your benefit, you may have the right to terminate the Service without penalty.
Changes will not affect rights already accrued before the changes take effect.
If you are not happy with any of these changes, you do not have to continue to top up your Plan or use the Service and you may end your Plan at any time as set out in accordance with Clause 12.
These Terms and Conditions are governed by the laws of the Republic of Ireland.
However, if you are a consumer resident in another country, you will continue to benefit from mandatory protections available under the laws of your country of residence irrespective of the choice of the laws of the Republic of Ireland.
Nothing in these Terms and Conditions limits any statutory consumer rights.
The Service is not intended for use by any person or entity in any jurisdiction or country where such use would be contrary to relevant law or regulation. Accordingly, persons who choose to access the Service from locations that prohibit such use do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
In case of dispute concerning the interpretation, execution and / or validity of the Terms and Conditions, express jurisdiction is attributed to the courts of the Republic of Ireland. However, if you are a consumer resident in another country, you may bring any judicial proceedings before the competent court of your place of residence or in the Republic of Ireland.
All intellectual property rights in the SIM Local website, application, branding, software, content, and related materials remain owned by SIM Local or its licensors.
Customers are granted a limited, non-exclusive, non-transferable right to use the Service and related application solely for personal and lawful use in accordance with these Terms and Conditions.

Customers are responsible for any misuse of the Service arising from their breach of these Terms and Conditions or unlawful use of the Service. Customers agree to reimburse SIM Local for reasonable losses, damages, or costs directly arising from:

The Service may rely on third-party providers, including:
SIM Local is not responsible for third-party products, services, applications, or websites which are outside SIM Local's reasonable control. Links to third-party websites or services do not imply endorsement by SIM Local.
Customers must not:
SIM Local may suspend, restrict, or terminate Services where fraud, abuse, or unlawful activity is reasonably suspected. Where appropriate, SIM Local may report suspected unlawful activity to relevant authorities.
Where Customers submit reviews, feedback, comments, or other content through the application or website, Customers confirm that such content:
SIM Local may remove content which reasonably breaches these standards or applicable law. Customers retain ownership of their content but grant SIM Local a non-exclusive right to use submitted feedback or reviews for customer service, operational, or promotional purposes.
Customers must not use the Service in violation of applicable sanctions, export controls, or telecommunications laws. SIM Local may restrict access to the Service where required to comply with legal or regulatory obligations.
